{"id":2780,"date":"2025-03-11T14:01:06","date_gmt":"2025-03-11T14:01:06","guid":{"rendered":"https:\/\/lapaz.bo\/smp\/blog\/?p=2780"},"modified":"2025-03-11T14:01:07","modified_gmt":"2025-03-11T14:01:07","slug":"derecho-de-via","status":"publish","type":"post","link":"https:\/\/lapaz.bo\/smp\/blog\/index.php\/2025\/03\/11\/derecho-de-via\/","title":{"rendered":"DERECHO DE V\u00cdA"},"content":{"rendered":"\n<h1 class=\"wp-block-heading has-text-align-center has-ast-global-color-1-color has-text-color has-link-color wp-elements-61de09341c1d96022f37a80b7306354e\"><strong>DERECHO DE V\u00cdA<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"has-text-align-right has-black-color has-text-color has-link-color has-medium-font-size wp-elements-519e2b4c7af0b5a773d5a8feec616a87 wp-block-paragraph\"><strong>Por: Evelyn Anah\u00ed Rojas Candia &nbsp;\u2013 Unidad de Investigaci\u00f3n y Pol\u00edticas Municipales<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-f32d62172f417523eb5b17cd1aafc808 wp-block-paragraph\">En el Art\u00edculo 2 de la Ley N\u00ba 966, del Derecho de V\u00eda y del Registro P\u00fablico de Dominio Vial (2017), se se\u00f1ala:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-e7d09e328272c103622df6a158b831ba wp-block-paragraph\"><em>\u201cEl Derecho de V\u00eda se constituye a t\u00edtulo de dominio p\u00fablico, recae sobre las carreteras de la Red Fundamental y sus elementos funcionales<a href=\"#_ftn1\" id=\"_ftnref1\"><strong>[1]<\/strong><\/a>, es inalienable, imprescriptible e inviolable, y permite la libre circulaci\u00f3n.<\/em> <em>Para fines de protecci\u00f3n, la naturaleza del Derecho de V\u00eda se extiende a las servidumbres viales u otros derechos secundarios, constituidos o afectados, que por sus circunstancias resultan de utilidad p\u00fablica.\u201d<\/em><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-51942769321af5358bae7c7dadc8c904 wp-block-paragraph\">En el <strong>Derecho de V\u00eda<\/strong> no podr\u00e1 realizarse obras ni se permitir\u00e1 m\u00e1s usos que aquellos que sean compatibles con el uso y la seguridad vial u otros servicios b\u00e1sicos estrat\u00e9gicos, sin que su implementaci\u00f3n afecte los niveles de seguridad vial (Ley N\u00ba 165, Art\u00edculo 197, 2011). La propiedad del terreno para Derecho de V\u00eda ser\u00e1 adquirida por el Estado, cuando ello sea preciso, por expropiaci\u00f3n o por negociaci\u00f3n con los propietarios (ABC, 2007).<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-0b52c6b9cbb9d58d8006d2a1a2ec8413 wp-block-paragraph\">El ancho de Derecho de V\u00eda ser\u00e1 definido por la autoridad competente del nivel central del Estado, considerando las necesidades y acuerdos internacionales (Ley N\u00ba 165, Art\u00edculo 197, 2011).
